1. Cardify is an independent application

Cardify is developed and offered by Prism Labs BV. Cardify is an independent collection and management application for collectors and is not an official Pokémon application.

Cardify is not produced, published, endorsed, supported, sponsored, or managed by The Pokémon Company, The Pokémon Company International, Nintendo, Creatures, GAME FREAK, or Wizards of the Coast. There is no commercial, organisational, or other affiliation between Prism Labs BV/Cardify and these companies, unless this is expressly and formally communicated otherwise in the future.

2. Rights to Pokémon and the Pokémon Trading Card Game

Pokémon, the names of Pokémon characters, and other Pokémon-related names, marks, and trademarks are protected by the intellectual property rights of their respective rights holders. Pokémon's official legal information states, among other things, that Pokémon and Pokémon character names are trademarks of Nintendo, and that copyright interests are associated with Pokémon, Nintendo, Creatures, and GAME FREAK.

Card images, artwork, illustrations, symbols, names, logos, game materials, and other protected elements from or related to the Pokémon Trading Card Game remain the property of their respective rights holders.

Prism Labs BV does not claim ownership of these trademarks, copyrights, illustrations, card images, or other third-party intellectual property rights.

3. Use within Cardify

To the extent Cardify displays names, card information, card images, illustrations, or other Pokémon-related materials, this is done solely within the functionality of the Cardify application for identification, cataloguing, collection management, and related informational purposes.

The fact that such material is displayed within Cardify must not be interpreted as a statement that Prism Labs BV owns this material, as an official licence or approval by the rights holders, or as evidence of a commercial partnership with Pokémon or other rights holders.

By using Cardify, users do not acquire any ownership right, licence, or other independent right of use over Pokémon-related materials. Copying, republishing, commercially exploiting, or otherwise using such material beyond what is legally permitted is done at the user's own responsibility.

4. Cardify's own intellectual property

The Cardify software, source code, database structure, technical architecture, own features, interface elements, own texts, own graphic elements, the Cardify name and logo, and other components originally developed by or for Prism Labs BV belong to Prism Labs BV or its licensors, to the extent intellectual property rights exist in them.

The use of Pokémon-related materials within Cardify does not affect Prism Labs BV's separate intellectual property rights in its own software, technology, and original content.

5. Third-party trademarks and names

All third-party trademarks, trade names, product names, logos, and other distinctive signs mentioned within Cardify remain the property of their respective rights holders.

A reference to a brand or rights holder is solely intended to identify the relevant product, card game, card, or other relevant material, and does not imply sponsorship, endorsement, or affiliation.

6. No permission granted by this disclaimer

This disclaimer is intended to make transparent that Cardify is independent and does not claim any ownership rights in Pokémon-related intellectual property.

This disclaimer does not, by itself, grant Prism Labs BV any copyright licence, trademark licence, or other permission from The Pokémon Company, The Pokémon Company International, Nintendo, Creatures, GAME FREAK, Wizards of the Coast, or any other rights holder.

Nor can the absence of an objection from a rights holder be interpreted as meaning that permission or a licence has been granted.

7. Notices from rights holders

Prism Labs BV respects the intellectual property rights of third parties. If a rights holder or their authorised representative believes that material within Cardify infringes their rights, they can contact Prism Labs BV at support@gocardify.io.

A notice should preferably contain sufficient information to identify the material concerned and the right being invoked, as well as the notifying party's contact details. Prism Labs BV will assess a sufficiently substantiated notice and, where appropriate, take suitable action.

8. Important legal note for Cardify

The presence of this disclaimer reduces the risk of confusion about a possible official relationship with Pokémon, but does not automatically resolve the underlying question of the right to use protected card images, artwork, or other Pokémon materials.

Pokémon states in its current official support information that it does not review requests to use Pokémon intellectual property, including characters, names, and designs, and asks that such intellectual property not be used with, or associated with, projects. The official terms of use also significantly restrict the use of Pokémon content largely to personal, non-commercial use.

For this reason, the actual use of Pokémon card images and other protected imagery in a commercial or paid Cardify service warrants a separate legal assessment. This disclaimer should not be regarded as a substitute for that assessment.

9. Short version for visible placement

The following short notice is used for the footer, app settings, or a compact legal page:

"Cardify is an independent application and is not affiliated with, endorsed, sponsored or approved by The Pokémon Company, Nintendo, Creatures, GAME FREAK or Wizards of the Coast. Pokémon, Pokémon character names, card images, artwork and related trademarks and copyrights are the property of their respective owners."

10. Translations

The visible disclaimer must be available in every language in which Cardify is offered to users. Translations must preserve the same substantive message: Cardify is independent, there is no official relationship or endorsement, and the Pokémon-related intellectual property rights remain with their respective rights holders.

Where translations differ, it is advisable to designate one contractual reference language in Cardify's terms and conditions. Cardify designates English as the reference language in the event translations differ.
